Cross & Bennett LLC began its False Claims Act/qui tam practice in the late 1990s. Since then Cross & Bennett LLC has pursued health care fraud, defense contracting fraud, and tax whistleblower claims.
Cross & Bennett LLC was instrumental in initiating and pursuing the largest health care fraud case in U.S. history, which was begun in January of 2003. Lead attorney Keith Cross worked tirelessly to assist the government in its prosecution of GlaxoSmithKline for a fraud that involved off-label marketing of 5 different drugs, including GSK's blockbuster drug Advair, and pay-offs to physicians in the millions of dollars for 9 of GSK's most heavily marketed drugs. GSK eventually settled the case in 2012 with a total payment of $3 billion, including over $1.042 billion in False Claims Act civil damages to the United States and state governments. The two whistleblowers originally represented by Cross & Bennett LLC were awarded a total relator share in excess of $74 million.
Attorney Keith Cross also worked extensively with Colorado state legislators in the drafting of one of the strongest state Medicaid fraud statutes in the country. According to the Office of Inspector General, Health and Human Services, Colorado's statute now meets or exceeds the strength of the federal False Claims Act, entitling the state to a 10% increase in revenues from successful FCA cases.
